These Terms and Conditions apply to all purchases made by you, the customer, from us, Max TV. Max TV is a trading name of Datel Direct Limited, which is a wholly owned subsidiary of Datel Holdings Limited.

Delivery
We aim to dispatch our products within 5-7 days of accepting your order. Products that are dispatched by our nominated carrier will require a valid signature as proof of delivery (POD). To protect you against fraud we are only able to deliver to the address that your card is registered to.
Delivery dates are not guaranteed, but we will make every reasonable effort to ensure that goods are delivered within 28 days of being ordered. We only deliver to addresses within GREAT BRITAIN. We do not deliver to BFPO addresses, PO Boxes, Scilly Isles or the Channel Islands. Northern & Southern Ireland deliveries may incur a surcharge for delivery depending on the item.
Occasionally items that are received are damaged in transit, if this occurs you must contact MaxTV within 24hours, retaining all packaging. Call centre staff will then arrange inspection of the item by the carrier. Where items are received back return to sender/ undelivered because a receiver refused delivery or was unable to accept delivery a refund will be processed less the cost of carriage. If the item has to be resent a further carriage charge will apply.
Availability
All orders are accepted subject to stock availability. Please note appearance of product and packaging may vary. Where you have ordered several products and not all are in stock, we may send you the products which are available; we will send the remainder of your order as soon as the stock becomes available. Your card will be charged in full for the total order only once the first item from your order ships.
If the goods ordered are out of stock, we will contact you within 30 days from the day after your order was placed. If the goods are coming back into stock, we will propose a new delivery date or, with your agreement, we may be able to supply you with substitute goods. If we have received payment from you for goods out of stock, or you do not wish to wait for goods to become available, and/or decline our offer of substitute goods, we will refund any monies due, within 7 days of receiving your instructions.
Vat
Prices on our website, and the Max TV channel all include VAT at the appropriate rate. For VAT refunds (where applicable), please contact our customer services department.
Ways to pay
To place an order call us on 0845 070 2571*, we are open 7 days a week. Our friendly, trained call centre staff will take your order. Your calls will be charged at low call rates. If you wish to place an order please have your credit or debit card to hand. We accept Visa, Switch, Maestro, MasterCard and Solo. Max TV customers must be 18 years of age or over. You will be asked to provide your personal details. It is your responsibility to ensure that the details provided by you for the purpose of ordering products from us are correct and that you have the necessary credit limits and/or authority to use the credit or debit card you present to us. Orders can also be placed on line 24 hours a day at www.max.tv where a PayPal facility may also be used.
Return Policy
Peace of Mind Guarantee
If you wish to return a product for any reason, you may do so within 7 days. You must, when examining the product exercise reasonable care in doing so in order that the item is not damaged in any way. In order to return items firstly obtain a Returns Authorisation Number (RAN) from Customer Services on 0845 070 2571*. Items must be returned in the original packaging and be in as new condition with all labels, tags and accessories included. To be assured that goods reach us we recommend that you return them by Recorded mail and package them securely, including the RAN in the package and marking the OUTSIDE of the package clearly with this number, but not defacing any part of the original packaging. It is your responsibility to ensure they do not get lost in transit. Upon receipt of the goods we will provide you with a full refund. We will not pay any amounts towards the cost of the postage.
If you wish to return an item which is not faulty after 7 days but within 28 days we will issue you with a credit note, excluding postage for the full retail value of the product upon receipt of the goods in new condition. In order to do this you must obtain a RAN number in the first instance before returning goods to us in the manner detailed above. Credit notes will be issued once it is clear that the goods are in working order and are as new. If goods are not returned in a satisfactory condition we reserve the right to return them to you without issuing a credit note.
All of our products are supplied with a 12 month warranty against manufacturing faults. Damage that results from normal wear-and-tear, inappropriate use, collision or as a result of the item being taken apart is not covered. If you believe an item sent to you, to be faulty or incorrect, please call Customer Services on 0845 070 2571* who will issue you with a Returns Authorisation Number (RAN). You should include a letter stating the reasons for return when sending your parcel back to us. The RAN number should be clearly marked on the OUTSIDE of the package. Goods which are returned without a RAN will not be accepted. Max TV does not accept any liability for returned goods, which remain the customers responsibility whilst in transit and recommend that the Royal Mail recorded delivery service is used.
Should the returned item be found to be faulty, we will replace or repair the item. If a replacement is not available or a repair is not possible we will supply a credit note or refund the retail value in full at our discretion. The cost of return postage for any reason will be borne by the customer.
We will not accept the return of any products or provide refunds for products which are over 12 months old under any circumstances.
We will not accept any returns for any reason where a Returns Authorisation Number has not been issued or where the RAN is not marked on the outside of the item.
Statutory rights
Goods must be returned to us in their original condition, complete with packaging and accessories. The cost of replacement of any missing items will be borne by the customer.
Liability
If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery, replace or repair any goods that are damaged or defective upon delivery, or refund you with the amount paid for the goods. This does not affect your statutory rights as a consumer, nor is it intended to limit our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
Safety advice
For your own safety we recommend that you read carefully all safety information printed either on the packaging, or in any leaflets that may be included with the product. For electrical products always check the power cable and plug for any signs of damage. Always consult a qualified electrician and never attempt to repair any product yourself.

Data protection
Max TV does not sell or exchange customer information with anyone else. We share relevant information only with those parties entrusted with the processing of your account and the fulfillment of your order and to parties entrusted by us to undertake customer surveys. We have established procedures to protect your privacy - and we uphold them vigorously. From time to time, we may write or telephone in order to update your account, or to give you information that we hope might interest you. WEEE Regulations
The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.
The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK.
Recycling reduces the environmental and health risks associated with sending electrical goods to landfill. MaxTV is obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us.
Customers must return their like-for-like WEEE item to us within 28 days of purchasing their new item at their own cost. Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.
Summary
By purchasing products from us, you agree to these terms of sale. Max TV has the right to revise these terms and conditions including prices at any time.
